Questions and answers
Everything worth knowing about an occasional lease address before you order.
★★★★★What is an occasional lease address?
In an occasional lease (najem okazjonalny) agreement, the tenant must indicate premises they will move to if the lease ends with eviction. A statement from the owner of those premises agreeing to their stay is attached to the agreement. Such premises are called substitute premises (lokal zastępczy), and in practice people simply say "occasional lease address".
The requirement comes from art. 19a of the Act on the Protection of Tenants' Rights. NajemOK prepares such a statement with your details.
Is the substitute premises a real flat?
Yes. It is an existing flat entered in the land register. The land register number is in the statement, so you, the landlord or the notary can check it for free in the EKW system of the Ministry of Justice at ekw.ms.gov.pl.
How much does the statement cost?
The Standard option costs 269 zł, the option with a notarised signature 299 zł. This is the final price: it does not depend on the number of tenants or the lease period, and InPost delivery is free across Poland.
You pay the notary separately for the notarial deed signed by the tenant. It is usually around 400–500 zł, depending on the office.
What is the difference with the notarised option?
In both options the statement is signed by the owner of the substitute premises. In the notarised option, the signature is additionally certified by a notary.
The law allows the landlord to demand such certification. If your landlord requires it or you are not sure, choose the notarised option.
After receiving the statement, do I have to go to a notary?
Yes, in every option. The tenant signs their own statement of submission to enforcement and vacating the flat at a notary. The law requires it to be a notarial deed. You take our statement with you to that appointment.
You can choose any notary office in Poland.
What details are needed to order?
Name, surname and the series and number of the passport, ID card or residence card of each tenant, the address of the rented flat, plus phone and e-mail for contact. Filling in the form takes about 2 minutes.
